Introduction

These terms and conditions are entered into by and between You and Omaha Airport Authority (“Omaha Airport Authority”, “we”, “us” or “our”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms and Conditions”), govern your access to and use of https://www.flyoma.com/, parkoma.com, and www.flyoma.com/parking-coupon/, including any content, functionality and services offered on or through https://www.flyoma.com/, parkoma.com, and www.flyoma.com/parking-coupon (collectively “Website”), whether as a guest or a registered user.

Please read the Terms and Conditions carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms and Conditions and our Privacy Policy, found at https://www.flyoma.com/privacy/, incorporated herein by reference. If you do not want to agree to these Terms and Conditions or the Privacy Policy, you must not access or use the Website.

Online Reservation System

ParkOMA provides an online parking reservation system at www.ParkOMA.com by which you may reserve parking at certain on-airport parking facilities and products (a “Reservation”). ParkOMA does not guarantee that all parking products will be available at all times via the online Reservation System, nor does it guarantee a specific parking space.

When you have submitted a request using the online Reservation form at www.ParkOMA.com, you will receive an email confirmation of your Reservation and a receipt of payment. Your Reservation is not complete until such time as the Reservation confirmation is received. This confirmation email will include your Reservation’s unique QR code, which is required to enter and exit the ParkOMA facility and is associated with the dates, times and parking fees specified within the Reservation.

The Omaha Airport Authority reserves the right to limit the number of Reservations per person and per parking facility and/or the number of parking spaces and products available for Reservations via the online Reservation System.

Online Reservation Purchase Price and Payment

The Reservation purchase price quoted by the online Reservation System is fixed only when you complete your Reservation. Until the Reservation is completed, quoted prices may vary depending on time of Reservation and availability.

The purchase price quoted by the online Reservation System does not include any overstays (time stayed in excess of the time purchased online in advance). For overstays, you will be charged current posted parking rates at exit.

When you provide your credit card details to complete your online Reservation, you are authorizing a ParkOMA PCI-DSS compliant vendor to charge your credit card in the amount of the quoted purchase price.

Online Reservation Period & ParkOMA Parking

If your vehicle is parked for any time outside the Reservation Period (e.g. if you arrive early or leave late) you will be charged for the time outside of the Reservation Period at current posted parking rates. These rates may vary from the rates quoted by the online Reservation System.

The Reservation Period and exit time may have been automatically extended to provide a grace period at no additional charge. If you overstay or stay longer than exit time / grace period there will be an additional charge that you can pay at any available exit lane.

You are required to park in a normally marked parking space and adhere to all regulatory signage. Vehicles parked in marked handicapped spaces must display appropriate credentials in accordance with Nebraska State law.

No reserved parking stay may exceed one-hundred and twenty (120) days. Any vehicle left unclaimed in excess of ninety (90) days after the original Reservation end date, in the absence of special arrangements with ParkOMA, will be removed at owner’s expense in accordance with the ParkOMA Abandoned Vehicle Policy.

Online Reservation and ParkOMA Capacity

In the event that the ParkOMA parking facility and product you have reserved has been closed and/or we cannot locate a parking space in that facility, ParkOMA will issue a full refund of your online Reservation charges and locate an alternative parking location for you.

North and South Garage reservations are valid for either garage (not including Premier) and if a garage is full and/or closed, you may be directed to the open garage. Reservations for the North and South Garage permit you to enter either facility with your QR code. If you reserved another ParkOMA facility and we are not able to accommodate you in that facility we will issue a full refund of your online Reservation charges.

South Canopy Lot covered parking spots are subject to availability.

Online Reservation Cancellations, Changes and Refunds

Please ensure that you check the Terms and Conditions posted at www.parkoma.com at the time of your Reservation and prior to entering into ParkOMA facilities.

Your ability to make cancellations, changes, and to receive a refund may vary depending on the type of your Reservation. Cancellations and amendments may be made to your Reservation by clicking “Manage My Reservation” or “My Reservations” and selecting the relevant options.

When changing a Reservation and the purchase price for the new requested Reservation period or product exceeds the purchase price for the original Reservation, you will be required to pay the difference between these amounts.

From time to time, ParkOMA may offer special promotional parking rates. These rates are based on a specific set of arrival and departure times. Reservations at these rates can be cancelled as described above, but cannot be changed. If cancelled, you can make a new Reservation at the ParkOMA rates available at that time.

Coupons or other offers cannot be used in conjunction with your online reservation unless allowed at the time that your reservation is made.

No Resale of Online Reservations

The resale or marketing of any ParkOMA Reservation, whether on its own or bundled with other products or services, is prohibited without the express written consent of the Omaha Airport Authority. Resale will result in the cancellation of the online Reservation without refund.

Parking Liability

You agree that you are parking at your own risk. Except to the extent permitted by law, the Omaha Airport Authority will not be liable for any personal injury, or damage to your vehicle or other property, or any special, indirect, or consequential loss, whether or not the Omaha Airport Authority could have foreseen such loss.

Accessing the Website and Account Security

We reserve the right to withdraw or amend this Website, and any service or material we provide on the Website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users, including registered users.

You are responsible for both:

• Making all arrangements necessary for you to have access to the Website.
• Ensuring that all persons who access the Website through your internet connection are aware of these Terms and Conditions and comply with them.

To access the Website or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Website that all the information you provide on the Website is correct, current and complete. You agree that all information you provide to register with this Website or otherwise, including, but not limited to, through the use of any interactive features on the Website, is governed by our Privacy Policy, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

If you choose, or are provided with, a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You also acknowledge that your account is personal to you and agree not to provide any other person with access to this Website or portions of it using your username, password or other security information. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you exit from your account at the end of each session. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

Intellectual Property Rights

The Website and its entire contents, features and functionality (including but not limited to all trademarks, information, software, text, names, logos, service names, designs, slogans, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Omaha Airport Authority, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Website.

No right, title or interest in or to the Website or any content on the Website is transferred to you, and all rights not expressly granted are reserved by Omaha Airport Authority. Any use of the Website not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark and other laws.

Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Website:

• In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
• For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.
• To send, knowingly receive, upload, download, use or re-use any material which does not comply with the Content Standards set out in these Terms and Conditions.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate Omaha Airport Authority, any of our employees, another user or any other person or entity (including, without limitation, by using e-mail addresses associated with any of the foregoing).
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm Omaha Airport Authority or users of the Website, or expose them to liability.
• To attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer or database connected to the Website.
• To attack the Website via a denial-of-service attack or a distributed denial-of-service attack.
• To otherwise attempt to interfere with the proper working of the Website.

Monitoring and Enforcement; Termination

We have the right to:

• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
• Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Website.
• Terminate or suspend your access to all or part of the Website for any or no reason, including without limitation, any violation of these Terms and Conditions.

Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the Website. YOU WAIVE AND HOLD HARMLESS OMAHA AIRPORT AUTHORITY AND ITS AFFILIATES, LICENSEES AND SERVICE PROVIDERS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF ITS INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER SUCH PARTIES OR LAW ENFORCEMENT AUTHORITIES.

Indemnity

You agree to defend, indemnify and hold harmless the Omaha Airport Authority, our affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms and Conditions or your use of the Website, including, but not limited to, any use of the Website’s content, services and products other than as expressly authorized in these Terms and Conditions, or your use of any information obtained from the Website.

Limitation of Liability
